Welcome to NDTJOBS (“Website”), owned and operated by LUTEK LLC (“Company”, “we”, “us”, or “our”). By accessing or using our Website and services, you (“User”, “you”, or “your”) agree to the following Terms & Conditions. These Terms & Conditions apply globally, though our legal governance is based in the United States, specifically in the State of Connecticut.

I. Acceptance of Terms

By accessing or using NDTJOBS, you confirm that you are over 18 years old and agree to these Terms. If you disagree, do not use our Website or services.

II. Nature of Our Services

NDTJOBS is a global, job-board platform dedicated to Non-Destructive Testing (“NDT”) roles. User-generated content (including job posts and candidate profiles) is displayed on the Website. While we moderate content to some extent, we rely on information users provide and do not independently verify certifications or job details.

III. Posting & Content

1. User-Generated Content

  • Employers and candidates (“Users”) may post job listings, resumes, and other materials (“Content”). You assume responsibility for the accuracy and legality of all Content you upload.

2. Prohibited Content

  • Users must refrain from posting offensive, discriminatory, defamatory, or fraudulent Content. Spam, malicious files, or deceptive postings are strictly prohibited. We reserve the right to remove or alter such Content without notice.

3. Liability Disclaimer

  • We disclaim responsibilities for inaccuracies, omissions, or misleading information in job postings or user profiles. Users are encouraged to verify details before making hiring or employment decisions.

IV. User Conduct & Responsibilities

  1. Certification Verification
  • We do not verify NDT certifications or qualifications. Employers and candidates acknowledge they must conduct independent checks where necessary.

2. Employer-Candidate Interactions

  • NDTJOBS acts only as a facilitator. We are not liable for any disputes, contractual issues, or on-site incidents arising from employment relationships formed through the Website.

3. Prohibited Activities

  • By using NDTJOBS, you agree not to scrape data, send unsolicited communications (‘spam”), or engage in activities violating applicable laws or harming other users.

V. Payment & Plans

  1. Monetization
  • Employers may purchase job listing packages via WooCommerce (which may use Stripe or other third-party payment gateways).

2. Refund Policy

  • We offer a 14-day refund on new job listing purchases if unsatisfied. Refund requests after 14 days are not honored.

3. Cancellation

  • Employers can cancel subscriptions at any time. Fees are not prorated; no partial refunds for unused subscription periods.

VI. Privacy & Data

  1. Data Collection
  • We collect personal information such as names, resumes, certifications, etc., for the purpose of matching candidates with employers.

2. Third-Party Sharing

  • We may share user data with third parties (such as analytics providers or partner services) in accordance with our Privacy Policy.

3. Regulatory Compliance

  • We aim to comply with relevant regulations (including GDPR for users in the EU), but users are responsible for reviewing our privacy policy to understand how data is processes.

VII. Intellectual Property

  1. Site Content
  • The layout, branding, text, and design of NDTJOBS are owned by LUTEK, LLC. You may not reproduce or distribute them without written permission.

2. User Content Licenses

  • Users retain ownership of their Content. By posting on NDTJOBS, you grant us a non-exclusive license to display and distribute your Content on the Website and other related channels.

VIII. Liability & Disclaimers

  1. Accuracy of the Listings
  • We do not guarantee the completeness or accuracy of job listings, resumes, or any other posted materials.

2. No Guarantee of Employment

  • We do not guarantee job placements, candidate suitability, or hiring success. Users assume all risk in employment relationships formed through the Website

3. Site Availability

  • We strive to maintain consistent service but do not guarantee uninterrupted or error-free operation

IX. Termination

  1. Right to Terminate
  • We may suspend or terminate accounts or remove Content at our sole discretion if we believe a user violates these Terms or applicable law.

2. Content Removal

  • We may remove job postings, profiles, or other user-submitted materials without liability if they breach our standards

X. Governing Law & Dispute Resolution

  1. Jurisdiction
  • These Terms are governed by the law of the United States, State of Connecticut.

2. Arbitration

  • Any disputes arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of an established arbitration body. By using NDTJOBS, you waive the right to a trial by jury.

XI. Indemnification & Miscellaneous

  1. Indemnify Clause
  • You agree to indemnify and hold harmless NDTJOBS, it’s owners, employees, and agents from any claims or damages arising out of your breach of these Terms, you use of the Website, or your violation of any rights of a third party.

2. Modification to Terms

  • We may update these Terms from time to time. We will notify users of significant changes by email or by posting a notice on the Website. Continued use after such changes constitutes acceptance of the revised Terms.
